Arbitration

Except as regarding any action seeking equitable relief, including without limitation for the purpose of protecting any Tutor Pace, Inc. information and/or intellectual property rights, any controversy or claim arising out of or relating to these Terms of Use or this Website shall be settled by binding arbitration in accordance with the commercial arbitration rules, in effect at the time the proceedings begin, of the American Arbitration Association. You agree to defend, indemnify, and hold Tutor Pace, Inc., its officers, directors, employees, agents, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of these Terms of Use.

Accounts And Security

Tutor Pace, Inc. does not warrant that the functions contained in the service provided by the Website will be uninterrupted or error-free, that defects will be corrected or that this service or the server that makes it available will be free of viruses or other harmful components.
As part of the registration process, each user will select a password ("Password") and Login Name ("Login Name"). You shall provide Tutor Pace, Inc. accurate, complete, and updated Account information. Failure to do so shall constitute a breach of this Terms of Use, which may result in immediate termination of your Account.
You may not:
(a) select or use a Login Name of another person with the intent to impersonate that person;
(b) use a name subject to the rights of any other person without authorization;
(c) use a Login Name that Website, in its sole discretion, deems inappropriate or offensive.
You shall notify Tutor Pace, Inc. any known or suspected unauthorized use(s) of your Account, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of your password. You shall be responsible for maintaining the confidentiality of your password.
Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of your Account, at Tutor Pace, Inc.'ssole discretion, and you may be reported to appropriate law-enforcement agencies.
You agree that you will not disclose any information to a Tutor that could be considered personally identifiable information including your full name, address, telephone number, email address, social security number, password or any other information that could be used to identify or locate you. A violation of this agreement may lead to a suspension of your account. Similarly, you agree that you will not solicit any such information from any tutor, and agree that if any tutor ever discloses such information to you, asks you for any personal information, or suggests any offline meeting or conversation, you agree to immediately report this to us by phone and in writing.
You acknowledge that we may screen User Content, and that we shall have the right (but not the obligation), in our sole discretion, to remove any User Content, including terminating tutoring sessions. Without limiting the foregoing, we have the right to remove any User Content that violates these Terms or is otherwise objectionable. You agree and acknowledge that we may preserve User Content and may disclose User Content if required to do so by law or in the good faith belief that any such preservation or disclosure is reasonably necessary to comply with legal process, enforce these Terms, respond to claims that any User Content violates the rights of third parties or protect our rights, property or personal safety or that of our users and the public.
You agree that if you defraud or access our system (or Tutors) through any method that is in any way improper, attempt to do so, or allow anyone else to do so, you will immediately pay us $50 per hour, plus all costs we incur related to detecting and investigating your improper action(s), for each hour (or part thereof) that you (a) obtain improperly, (b) use, and/or (c) allow anyone else to use.
You agree that our cost of investigation will always be a minimum of $250 and will include inside and outside attorney and paralegal time and related fees, as well as the fees of private and forensic investigators and all court and other costs associated with collecting the amounts you owe, such as the costs related to requesting subpoenas from courts and then serving those subpoenas on you as well as serving them on Internet Service Providers, phone companies, schools, and other persons or organizations that we feel may be able to assist with our investigation. Further, you explicitly agree that if you have at any time provided us with a valid credit card number for any reason, including initial authorization of your account, you hereby explicitly agree that we have your approval to charge your card for the full amount of the time you obtained improperly, plus a minimum of $250 towards our costs.

Billing

Refund Policy:

  • Student can request 100% refund after 1 hour of tutoring session if not satisfied with services.Refund can only me made with in 10 days from the date the account is opened.
  • If student request a refund after using more than 1 hour of tutoring, refund can be requested for unused time. The refund can only be made with in 30 days from the date the account is opened.
  • Company has a right to deduct a nominal fee of up to $10.00 to cover administrative cost.
  • If a students requested a refund/cancellation of their account for any reason. Their account will be closed immediately unless students re-subscribe in the future.
  • Refund request can be made by sending email to customercare@tutorpace.com
  • Once the refund request initiated per customer request, allow 5-7 working days for funds to appear on your statement.

Cancellation Policy:

  • Student can cancel their account by calling customer care team at 1-800-665-6601 or by sending an email to customercare@tutorpace.com
  • Once student cancelled their account, your account will not be billed again unless you re-subscribe in the future.
  • If a student requested a refund/cancellation of their account for any reason. Their account will be closed immediately unless students re-subscribe in the future.

Renewal Policy:

  • Once student purchased any tutoring plan, their credit card is charged immediately.
  • Your account will be auto renewed on the last day of subscription date unless you call us to cancel your account before the expiration of their subscription plan.
  • In months with fewer than 31 days, we charge your card on the last day of the month if your numerical billing date does not occur.
  • In case of weekly subscription plan, your credit card will be charged everyweek unless you cancel your account by email to: customercare@tutorpace.com.

Pricing

Tutor Pace, Inc reserves the right to change prices without advance notice and to offer promotions periodically to certain group of customers and thus not available to all customers. Prices will not rise during the current month of subscription.

Fair Usage Policy

Under a monthly tutoring subscription, Tutor Pace, Inc. offers unlimited scheduled and instant sessions for a single student. Unlimited sessions are subject to 32 sessions of 0.45 minutes of tutoring in a month. Every student must have his or her own tutoring subscription and must not overbook sessions and not attend them. Subscription abuse applies to usage of one account by multiple students in the same family, sharing a subscription with others or booking many sessions and not showing up for them and using more than 32 sessions of 0.45 minutes of tutoring in a month. These constitute a violation of the terms of service and Tutor Pace, Inc. reserves the right to cancel a customer account or limit usage if there is suspected account abuse. If your account is suspended or limited please contact customer service. Cancelled or limited accounts are not entitled to any refunds for used or unused subscription services so keep your account login information confidential and private and cancel sessions you can't attend to allow booked tutors to be available to help other students.

Unlimited Tutoring

Students can get as many tutoring sessions in all subjects as they need subject to availability of tutors. Students usually schedule sessions in advance. TutorPace has the right to place temporary restrictions on usage during peak hours or with certain tutors to ensure availability of sessions to all students. TutorPace reserves the right to change the description of the unlimited tutoring package whether it is to place restrictions on usage, limiting the subject, sessions, tutors or any other parameters considered "unlimited" without notice.
